The way in which the ATFs lost money due to the ELV Cartel
From 2002 to 2017, fifteen major automotive manufacturers including BMW, Volkswagen, Toyota, Renault, and Ford collaborated through ACEA to implement a "zero-treatment strategy." This cartel involved a joint refusal to compensate recyclers for the lawful treatment of End-of-Life Vehicles (ELVs), in breach of EU competition law.
Why This Matters
Under EU regulation, ELV treatment involves significant operational costs related to environmental compliance, dismantling, logistics, and safety. The cartel's coordinated conduct shifted these costs downstream, burdening dismantlers and recyclers across Europe without fair negotiation or remuneration.
The European Commission has issued a binding infringement decision. That means recyclers do not need to prove the existence of the cartel, only their individual harm. With LitFin's support, affected businesses can now pursue their claims in a fully funded, professionally managed process.
